FBI Leaders Face Court Over Laptop Case
Prosecutors argue two former agents misled Congress about their role in the Hunter Biden laptop investigation.

Former FBI officials Nikki Floris and Bradley Benavides appeared in federal court in Washington on Tuesday to answer charges that they lied to lawmakers about their involvement in the Hunter Biden laptop probe. The hearing marks the first legal test of a criminal complaint filed by the Justice Department against the two former agents.
The government accuses Floris and Benavides of falsely denying knowledge of the laptop to members of Congress in 2023. The complaint states the pair failed to disclose their participation in internal FBI discussions regarding the device. Defense attorneys plan to challenge the validity of the charges during this preliminary proceeding.
A key point of contention for the defense is the procedural path of the case. The criminal complaint was signed by a magistrate judge rather than being voted on by a grand jury. Lawyers for Floris and Benavides argue this unusual step suggests the Justice Department struggled to secure a standard indictment in the capital. The department has faced difficulty persuading grand juries to act in several high-profile cases recently.
The case centers on a laptop that the Justice Department says Hunter Biden left at a computer repair shop in Delaware in 2019. The New York Post reported obtaining a hard drive from the device through Rudy Giuliani. The story surfaced in late 2019 and sparked intense scrutiny of the Biden family’s finances and foreign business ties in the run-up to the 2020 election. Former Director John Ratcliffe stated at the time that the laptop showed no signs of Russian involvement.
Floris and Benavides led the Foreign Influence Task Force, a unit created during the first Trump administration to monitor foreign meddling in U.S. politics. In August 2020, they briefed Republican Senators Chuck Grassley and Ron Johnson while the lawmakers investigated Hunter Biden’s work in Ukraine. The senators later criticized the FBI, claiming the agency tried to link their inquiries to Russian disinformation efforts. The task force was dissolved by then-Attorney General Pam Bondi in February 2025.
The Justice Department announced the charges on Friday. Prosecutors view the case as part of a wider review of investigations related to the former president’s son. Hunter Biden received a presidential pardon in late 2024 after facing felony convictions on gun and tax charges stemming from the same period. The midterm elections are scheduled for next week.
The court will determine whether the evidence is sufficient to hold a full trial. Both defense lawyers described the case as politically motivated. The prosecution maintains that the former officials omitted critical facts during their congressional testimony.
